§ 4-8. Location of licensed operation: Distance requirements.

  • (a)

    Licenses shall be issued only for locations in an area zoned in one of the city's commercial zones.

    (b)

    No person may sell or offer to sell any distilled spirits, malt beverage or wine in or within 100 yards of an alcohol treatment facility.

    (c)

    The term "alcohol treatment facility" shall include any alcohol treatment facility operated by the state or the county government.

    (d)

    For purposes of this section, distance shall be measured according to the most direct route of travel method as is described and defined in publications and rules of the Georgia Department of Revenue.

    (e)

    As to any location licensed in the future, if the distance requirements in this section are met at the time of issuance of any license, the subsequent opening and operation of an alcohol treatment facility with the distance prohibited in this section shall not prevent the continuance of an existing license or the renewal thereof or the issuance of a new license to any subsequent owner of such property.
